City of Houston Restroom Use Ordinance

The City of Houston Restroom use ordinance is Sec. 28-20. of the Code of Ordinances. It is titled "Entering restrooms of opposite sex"
Section 28-20 has been part of the Houston Code of Ordinances since before 1963.

Sec. 28-20. – Entering restrooms of opposite sex.
It shall be unlawful for any person to knowingly and intentionally enter any public restroom designated for the exclusive use of the sex opposite to such person’s sex without the permission of the owner, tenant, manager, lessee or other person in charge of the premises, in a manner calculated to cause a disturbance.


 

Based on Section 28-20 and other resources, the Transgender Foundation of America drafted and published suggested restroom-use policies for businesses and venues in the City of Houston and for those outside the City of Houston.

In compliance with the City of Houston Code of Ordinances Sec. 28-20, individuals should use whichever restroom they feel is appropriate based on the way they are presenting themselves.
